The bids submitted ranged from $5,900,000.00 to $7,468,065.00. The Engineer’s Estimate for this project was $7,114,525.00. A careful review and analysis of the three (3) lowest responsive and responsible bids received showed only minor deviations. See the attached spreadsheet and list of deviations for a detailed breakdown of each bid. Vinciguerra Construction, Inc. is the apparent low bidder. I contacted the Contractors State License Board and confirmed the following: • License Number: 358838 • Status: Current and active • Expiration Date: February 28, 2027 • Entity Type: Corporation • License Classification: Class A – General Engineering, Class B – General Building, Class C31 – Construction Zone Traffic Control, and Haz – Hazardous Substances Removal Certification. Additionally, I verified with the California Department of Industrial Relations that Vinciguerra Construction, Inc. is properly registered under PWCR Number 1000064348. The entities were nevertheless readily identifiable and successfully verified. o The addresses provided for San Joaquin Electric and Tyrrell Resources, Inc. did not match the addresses listed on CSLB and/or DIR records. The subcontractors were nevertheless verified as properly licensed and registered. o MCW Traffic Control was listed on the Bid Form; however, CSLB and DIR records identify the entity under its parent company, MCW Construction Group, Inc. The subcontractor was successfully verified through both agencies. • DBE Review o Vinciguerra Construction’s DBE submittal for the 2026 Pioneer Trail Waterline Project (Rebid) was reviewed for conformance with Section 00 73 00, including the Good Faith Efforts requirements in Exhibit A and the bid-time submittal requirements in Exhibit C. The bidder provided the required DBE Good Faith Efforts Verification materials, DBE Solicitation Log, supporting outreach documentation, and Bidders List. The outreach record shows the project was advertised through DBE outreach resources on May 8, 2026, ahead of the June 9, 2026, bid opening, and included solicitation of DBE firms for multiple work scopes together with language offering to divide work where economically feasible and assist firms with bonding, insurance, equipment, materials, and supplies. The submitted Bidders List identifies 31 total bidders/quoters, including 5 DBE firms, and shows 1 DBE firm selected, MCW Traffic Control, for traffic control work. The Caltrans DBE look-up resource is currently unavailable due to Federal changes to the classification of DBEs, whoever a past certification for MCW was included that the District was able to find MCW listed as a DBE for another agency. Based on the submitted bid documents, the DBE package appears responsive and the bidder’s Good Faith Effort documentation is acceptable. Bidder: T & S Construction, Inc. o List of Subcontractors o The subcontractor addresses provided for Martin Brothers Construction and San Joaquin Electric did not match the California Contractors State License Board (CSLB) and/or the Department of Industrial Relations (DIR) records. The entities were nevertheless readily identifiable and successfully verified. Bidder’s General Information o T & S Construction Co., Inc. was listed on the Bid Form. CSLB records identify T & S Construction Co., Inc. as a dba of Thomas B. Spinella Construction. The entity was successfully verified. o Item 6, The Bid Form identified the insurance broker and broker agency; however, the name of the insurance company was not provided. The insurance company information was subsequently obtained and verified directly with the broker. DBE Review o T & S Construction Co., Inc.’s DBE submittal for the 2026 Pioneer Trail Waterline Project (Rebid) was reviewed for conformance with Section 00 73 00, including the Good Faith Efforts requirements in Exhibit A and the bid-time submittal requirements in Exhibit C. T&S submitted a DBE outreach package documenting use of DBE search resources, direct solicitations, advertisements, and follow-up efforts consistent with the required good faith effort framework. Despite this outreach effort, T&S did not identify any bids received from DBEs. As part of Staff’s review, Martin Brothers and San Joaquin Electric were identified as subcontractors in the Bid Forms but were listed as not being used in the DBE Bidders List of all bids received. Staff noted this inconsistency but did not make a recommendation regarding the materiality of the deviation because T&S was not the apparent low bidder. Based on the submitted bid documents, Staff found that T&S documented substantial outreach and good faith efforts, but no DBE participation was achieved. Bidder: Tungsten Engineering Contractors o List of Subcontractors o The addresses provided for Cell-Crete Corporation and San Joaquin Electric, Inc. did not match the addresses listed on the California Contractors State License Board (CSLB) and/or Department of Industrial Relations (DIR) records. The subcontractors were nevertheless verified as properly licensed and registered. o Soil-Tech was listed on the Bid Form; however, CSLB and DIR records identify the entity as Soil-Tech, Inc. dba Soil Tech Environmental, Inc. The subcontractor was successfully verified. o Nevada Barricade & Sign Company, Inc. was listed on the Bid Form. CSLB records identify the entity as a dba of Golden State Striping & Sign. The subcontractor was successfully verified. Bidder’s General Information o The Bid Form provided the brokerage and agent information; however, the surety information was not completed. The surety was identified and verified from the Bid Bond submitted with the bid. o Item 6, The name of the insurance company listed on the certificate is not complete-Does not match AM Best or CDI. DBE Review o Tungsten Engineering Contractors’ DBE submittal for the 2026 Pioneer Trail Waterline Project (Rebid) was reviewed for conformance with Section 00 73 00, including the Good Faith Efforts requirements in Exhibit A and the bid-time submittal requirements in Exhibit C. Tungsten submitted the required DBE Good Faith Efforts Verification, Bidders List, and DBE Solicitation Log, and identified itself in the grant forms as a DBE prime contractor. Based on the completed Good Faith Efforts form excerpt provided, Tungsten indicated that it used a DBE directory search and direct email or written solicitation to identify potential DBEs, and did not indicate use of existing solicitation lists, procurement website posting, outreach to SBA or MBDA, or other identification resources. The DBE Solicitation Log reflects outreach to additional DBE firms for trucking, traffic control, arborist, and precast work, including West Coast Water Trucking, Roll N’ Rock, Tyrrell Resources, Inc., and Structure Cast, with responses shown as received. o Although STPUD was unable to independently verify Tungsten’s certification and their subs through the California certification system during the review period, Staff was able to verify that Tungsten is listed as an SBE with the Nevada Department of Transportation, which is consistent with the contract documents’ recognition of SBE as an acceptable DBE category and acceptance of certifications from state and local government transportation certification programs. o The contract documents also identify use of the SBA and MBDA as part of the six good faith efforts framework, but Tungsten’s submitted form did not indicate that those resources were used - Staff noted this inconsistency but did not make a recommendation regarding the materiality of the deviation because Tungsten was not the apparent low bidder.
