AN ORDINANCE OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT
SUPERSEDING ORDINANCE 529-11 AND AMENDING ADMINISTRATIVE CODE
SECTION 6.4.11 AND THE ASSOCIATED APPENDIX FEE SCHEDULE SECTION
6.4.11 REGARDING THE WATER LEAK ADJUSTMENT POLICY
Be it enacted by the Board of Directors of the South Tahoe Public Utility District, County
of El Dorado, State of California, as follows:
SECTION I - POLICY AND PURPOSE
The purpose of this Ordinance is to adopt an updated version of the District's Water Leak
Adjustment Policy and amend the associated sections of the Administrative Code.
SECTION II — DEFINITIONS
For the purposes of this Ordinance, the terms used herein are defined as follows:
A. The District — The South Tahoe Public Utility District.
B. The Board — The Board of Directors of the South Tahoe Public Utility District.
C. Administrative Code — The compilation and codification of all of the
Administrative, Water and Sewer Ordinances of the District, which establish the
authority and the principles for the decisions of the District, and provide the
public with guidelines applicable to District operations.
SECTION III — FINDINGS
The Board of Directors of the South Tahoe Public Utility District, El Dorado County,
State of California, makes the following findings:
1. The Board passed and adopted Ordinance No. 529-11 in 2011 which established a
policy for crediting customer accounts for water usage charges related to water leaks.
2. The District has acquired new technology in recent years which has automated the
detection of water leaks for customers.
3. The District has changed from quarterly to monthly billing periods.
3. The Board has determined that it is in the best interest of the District and its
customers to update the Water Leak Adjustment Policy to reflect modern leak detection
technology and monthly billing periods.
SECTION IV — AMENDING SECTION 6.4.11 OF THE ADMINISTRATIVE CODE
Section 6 4 11 ("Water Leak Adjustment Policy") of the South Tahoe Public Utility
District Administrative Code is hereby amended to provide as follows:
"6.4.11 Water Leak AdjustmenI Policv. Water meter errors and water leak
adjustments shall be addressed pursuant to the District's Water Leak Adjustment Policy. The
Water Leak Adjustment Policy has been adopted by the District's Board and may only be
modified through action taken by a majority vote of the District's Board. See Appendix Fee
Schedule for fees related to meter testing."
SECTION V — AMENDING APPENDIX FEE SCHEDULE SECTION 6.4.11
Appendix Fee Schedule Section 6 4 11 ("Meter Tests") of the South Tahoe Public Utility
District Administrative Code is hereby amended to provide as follows:
6.4.11 Meter Tests
Water Meter Size Test Charge
Meters up to 1.5 Inch $150.00
All Other Meters As Quoted by 3d Party Tester
SECTION VI — SEVERABILITY
If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this
Ordinance and its implementing rules and regulations is for any reason held to be
unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of
this Ordinance or the Administrative Code. The Board of Directors declares and determines that
it would have passed section, subsection, subdivision, paragraph, sentence, clause or phrase
thereof of this Ordinance and its implementing rules and regulations and the Administrative
Code irrespective of the fact that any one or more sections, subsections, subdivisions,
paragraphs, sentences, clauses or phrases may be determined to be unconstitutional or invalid.
SECTION VII — EFFECTIVE DATE
This Ordinance amending the above referenced sections of the Administrative Code shall
take effect thirty days after its passage.
PASSED AND ADOPTED by the Board of Directors of the South Tahoe Public Utility
District at its duly held regular meeting on the 2nd day of April 2026, by the following vote:
